Terms of Service

These Terms of Service ("Terms") govern your use of ServeFlow Ops ("the Service"), a hospitality operations platform provided by ServeFlow Ops ("ServeFlow", "we", "our", or "us") through the website at serveflowops.replit.app and our iOS and Android apps. By creating an account, signing in, or otherwise using the Service, you agree to these Terms.

1. Eligibility and accounts

The Service is intended for hospitality businesses and the staff they invite. You must be at least 16 years old and able to enter into a binding contract to use it. You are responsible for the activity that happens under your account, including keeping your password secure.

2. Workspaces, roles, and admins

The first user to register an organisation becomes the admin of that organisation and the workspace it owns. The admin may invite additional members as staff or admins. The admin is responsible for the data the workspace holds and for managing access to it.

3. Plans, billing, and cancellation

ServeFlow Ops offers a Free plan and paid plans (Standard and Growth). Paid plans are sold and managed only on our website at serveflowops.replit.app via our payment processor, Stripe. Prices and what each plan includes are listed on the website. Subscriptions renew monthly unless cancelled. You can cancel a paid subscription at any time from inside the app (Settings → Cancel) or from the website. Cancellation takes effect at the end of the current billing period; you keep paid features until then. We do not provide pro-rata refunds for partial months.

5. Your content

You and your workspace retain ownership of the operational data you put into ServeFlow Ops (checklists, tasks, photos, inventory records, etc.). You grant us the limited right to host, transmit, and display that content as needed to operate the Service for you.

6. AI features

Some features (for example, AI-powered inventory scanning) send the relevant input to OpenAI's API. We do not use your content to train third-party models, and OpenAI does not retain API inputs for model training under our agreement with them. AI output is provided on a best-effort basis; you are responsible for reviewing it before relying on it.

7. Service availability

We work to keep the Service available, but we do not guarantee uninterrupted access. We may release updates, change features, or perform maintenance from time to time.

8. Account deletion

You may delete your account at any time from inside the app (Settings → Delete Account). Deletion is permanent. If you are the sole admin of an organisation, deleting your account also deletes the organisation and all of its operational data, and immediately cancels any active Stripe subscription on that organisation. Other workspace members will lose access at that point.

9. Termination by us

We may suspend or terminate your access if you breach these Terms, if we are required to by law, or if continued service to you would put the Service or other customers at risk.

10. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties (express or implied) including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the fullest extent permitted by law, ServeFlow's total liability arising out of or in connection with these Terms or the Service is limited to the amount you paid us for the Service in the 12 months immediately before the event giving rise to the liability, or A$100, whichever is greater. We are not liable for indirect, incidental, consequential, or special damages, including lost profits or data. Nothing in these Terms limits any liability that cannot be excluded by law (including under the Australian Consumer Law).

12. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will update the "Last updated" date and, where appropriate, notify workspace admins by email. Continued use of the Service after a change means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of Queensland, Australia. The courts of Queensland have non-exclusive jurisdiction over any dispute.
